The Jos judicial division of the Court of Appeal on Thursday adjourned the matter between Hon. Yakubu Sanda Vs the former Speaker, Hon. Ayuba Abok till 8th June 2023.
Recall, that the Appeal Court presided over by Justin T.Y Hassan had refused to grant the Prayers sort by Yakubu Sanda and other appellants seeking to restrain Ayuba Abok from Presiding as the Speaker of the Plateau House of Assembly and adjourned the Matter till 25th, May and later to 1st, June 2023.
When the Matter came up for hearing on Thursday, June, 1st, there was confusion at the Court when Two Counsels A.H Ruba (SAN) and P.M Lere announced their appearance for the Appellants.
The drama began when P.M Lere Filed an Application to discontinue the matter on behalf of the Clark of the State Assembly and the three other Members Which includes the Member Representing Shandam, Wase, and Bokkos Constituencies who are also Appellants.
According to the P.M Lere, their application to discontinue the matter is based on the fact that the Judgement of Justice ML Musa of the Plateau State high court which reinstated Ayuba Abok as the Speaker of the state Assembly has already been executed and they have been part of the Plenary Sessions presided over by Ayuba Abok.
However, the other Counsel for the Appellants A.H Ruba argued that he has been briefed by the outgone Government to file the appeal on behalf of all the Appellants.
After the heated arguments, the Presiding Judge Justice T.Y Hassan directed the Two Counsels who announced their appearance for the Appellants to go and sort themselves out.
The Court further asked the Parties to maintain status quo which is the Judgment of Plateau State High Court that reinstated Rt. Hon. Abok Nuhu Ayuba as the Speaker of the Plateau House of Assembly.
Justice T.Y Hassan thereafter adjourned the matter Till 8, June 2023. To hear the Motion on Notice for Stay of Execution.
